These General Terms and Conditions (hereafter the "GTC") define the rights and obligations of BOUTIQUE SAINT AIX and any consumer wishing to purchase the Products offered for sale by the Seller. These GTC govern their contractual relationship and can be viewed on the Website https://www.aixrose.com/en/bou... (hereafter the "Website").

article 1. the seller - legal information

These General Terms and Conditions apply to the sale of Products offered by BOUTIQUE SAINT AIX, a simplified joint stock company with a capital of 10,000 euros, having its registered office at Domaine de la Grande Seouve - 13490 JOUQUES, registered in the Aix-en-Provence Trade and Companies Register under number B 895 254 977.

article 2. scope of application

These GTC constitute with the invoices, the contractual documents opposable to the Parties and prevail and cancel any other document. They specify the conditions of order, payment, delivery, management of returns, etc.

They are available to the Customer and can be viewed directly on the Website. They are binding on the Customer, who acknowledges having read them and accepted them before ordering. The validation of an Order implies the Customer's unreserved acceptance of the GTC.

BOUTIQUE SAINT AIX reserves the right to amend these Terms and Conditions at any time to comply with any new regulations. The applicable GTC will be those in force on the date of the Order by the Customer. The Customer who does not wish the contractual relations to be governed by the new version must notify it.

article 3. the products offered

3.1. The Products

BOUTIQUE SAINT AIX offers for sale online accessories and products derived from the AIX / AIX Rosé trademark (hereinafter the Products). These are a selection of AIX Rosé gifts such as ice buckets of different sizes, gift boxes with glasses, corkscrews, magnum gift boxes, aprons, drop stop, tote-bags, hats, plaids, set of boules and notebooks.

The essential and main characteristics of the Products and in particular the descriptions, illustrations, materials, dimensions, colors as well as their price are presented on the Website with the best possible accuracy.

The photographs and illustrations on the Website are indicative; the Customer acknowledges and accepts that the image and colors of the latter may not correspond to the actual Product. BOUTIQUE SAINT AIX cannot be held responsible for any non-substantial differences between the photographs and the Product received. The description of the Product is the only source of contractual information.

3.2 Unavailability of the Products

The Products are valid within the limits of existing available stocks. BOUTIQUE SAINT AIX frequently updates availability but cannot be held responsible if the stock is no longer the same as the indicated one. In case of unavailability, the Customer will be informed as soon as possible.

In the event of a short-term stock shortage (less than 7 days), BOUTIQUE SAINT AIX reserves the right to postpone shipment for a few days while the Products are back in stock. In case of unavailability for a longer period, BOUTIQUE SAINT AIX will proceed with the reimbursement of the sums paid within three (3) weeks. BOUTIQUE SAINT AIX is not liable for any other cancellation indemnity and cannot be held responsible in case of unavailability of a Product.

article 4. price

4.1. Sales price

The sales prices of the Products are indicated on the Website in Euros, all taxes included, and consider the VAT applicable at the time of the Order, any customs duties, and do not include shipping costs (for orders of less than 100 euros, above this amount delivery costs are free).

In case of commercial operations, a price reduction or free delivery may be granted. If there is no mention of this on the Website or if a code is obtained, no reduction will be applied.

BOUTIQUE SAINT AIX reserves the right to modify its prices, being specified that the price appearing on the day of the Order will be the only one applicable to the Customer.

In all cases, the final price is indicated on the confirmation page, including all taxes, the applicable VAT as well as packaging costs. To this price must be added the shipping costs applicable on the day of the order, the latter being at the buyer's expense. The costs are estimated at the time of each Order.

An invoice will be sent to the e-mail address provided by the Customer.

4.2. Payment

The payment is made in its entirety at the time of the Order.

The payment is made online by credit card 100% secure. Online payments are secured via Mollie by a data encryption procedure to avoid the risk of interception of this information by ill-intentioned third parties.

The Customer's bank account will be debited after the Order has been validated and the Order will be effective after confirmation of the agreement of the banking payment centers.

The Customer guarantees that he/she is fully authorized to use the bank card used, whether he/she is the holder of the card or has received authorization from the holder, and guarantees that the means of payment gives access to sufficient funds. BOUTIQUE SAINT AIX is not responsible in case of fraudulent use of the means of payment used by the Customer.

BOUTIQUE SAINT AIX reserves the right to refuse any Order or delivery in the event of refusal of payment authorization by the banking organization.

article 5. order

5.1. Order process

To place an order, the Customer does not need to create an account, he/she can place an instant buy. To do so, the Customer must select the Products he or she wishes to purchase, specifying the quantity and, if applicable, the dimensions required, to add them to his or her online shopping cart, and then fill in a minimum amount of information (first name, last name, shipping/billing address, e-mail address).

It is the Customer's responsibility to verify the content of his or her Order before proceeding with payment. After having checked the accuracy of the Order, the Customer chooses the type of delivery and payment method and validates the Order. After validation, the Customer is directed to a secure page to proceed with the payment of the Order. The Order will be confirmed by BOUTIQUE SAINT AIX by sending a summary e-mail which will be considered as a definitive sale once the total price has been received.

The Customer undertakes to check that he/she has received this e-mail in his/her e-mail box and in his/her spams.

5.2. Special features

The Customer confirms that he/she is of legal age and accepts the general terms and conditions when he/she opts in by clicking the acceptance of these General Terms and Conditions box when placing the Order.

The Customer is solely responsible for the accuracy and validity of the information provided. BOUTIQUE SAINT AIX cannot be held responsible for any errors in the information provided or their consequences.

5.3. Non-acceptance of an Order

BOUTIQUE SAINT AIX reserves the right to refuse, reduce or split all or part of an Order if the quantity ordered or the frequency of orders seems abnormal, if the Product(s) ordered is (are) not available in stock, due to an inability to obtain payment authorization, a pricing error or suspected fraud.

article 6. delivery of products

6.1. The delivery

The Product(s) will be delivered by registered mail by third-party carriers within Europe, except for the United-Kingdom, according to the delivery method chosen by the Customer. Delivery methods and costs are presented on the Website before the Order is validated. Please allow 7 working days for delivery. Please note that orders placed between the 22nd of December and 2nd of January will be shipped only from the 3rd of January.

As soon as the Sales Order is confirmed and the price paid, BOUTIQUE SAINT AIX commits itself to doing its utmost to deliver the Sales Order to the address indicated by the Customer as quickly as possible. The delivery times indicated are given as an indication only and correspond to the average delivery times.

The Products ordered shall be delivered at the same time. If the Order includes Products with a longer delivery time, the longer delivery time shall apply as the reference for the delivery.

6.2. In case of delay

If BOUTIQUE SAINT AIX is unable to deliver an Order within the time limit indicated, the Customer will be informed as soon as possible. BOUTIQUE SAINT AIX will not be held responsible in the event of a delay attributable to the Customer, the carrier, a case of force majeure (strikes, transport network blockages, bad weather, etc.) or an insurmountable event outside of its control (epidemic, border closures, etc).

If BOUTIQUE SAINT AIX cannot meet the announced deadline for another reason and in the event of a delay of more than thirty (30) days, the sale can be cancelled at the request of the Customer. The Customer will have to ask BOUTIQUE SAINT AIX to make the delivery within an additional period. If it fails, the sale will be cancelled, and the Customer will be reimbursed for the totality of the sums paid within a maximum period of fourteen (14) days following the cancellation of the sale.

6.3. In case of issues with the delivery

In case of an erroneous address leading to the impossibility of delivery, the Customer will have to pay the forwarding expenses. The Customer is solely responsible for the consequences of delivery to a collective or erroneous address.

BOUTIQUE SAINT AIX declines all responsibility in case of non-receipt due to a third party (loss, theft, etc.) or force majeure.

If the package is returned to BOUTIQUE SAINT AIX, a second delivery will be made at the Customer's expense. BOUTIQUE SAINT AIX will contact the Customer to obtain additional instructions and may charge additional storage and delivery fees.

If despite all efforts, BOUTIQUE SAINT AIX is unable to deliver the Order, it may terminate the contract and proceed with the reimbursement of the Order as well as the deduction of a compensatory indemnity.

6.4. Receipt and complaint

Upon receipt of the Order, the Customer agrees to check the condition of the packaging and the conformity of the package with the Order placed. In the event of damaged packaging, the Customer must refuse delivery, request the return of the package, and immediately notify BOUTIQUE SAINT AIX of this refusal.

Any anomaly (missing product, damaged package, non-conforming product, broken product, etc.) must, under penalty of inadmissibilitý of the request, be indicated on the delivery slip in the form of detailed handwritten reserves, motivated and dated. The Customer must sign the delivery slip and report these anomalies to BOUTIQUE SAINT AIX within four (4) working days of receipt by sending an email to boutiqueaixrose.com specifying the order number, any photos and description of the problem. Any claim made after the deadline will be rejected and the Products will be deemed compliant.

The guarantee of conformity does not apply in case of damage caused by the storage of the product.

When the complaint procedure has been complied with, BOUTIQUE SAINT AIX may ask the Customer to illustrate / demonstrate the anomaly. Once this anomaly is recognized, the return of the Product will be made at the expense of BOUTIQUE SAINT AIX and the refund or exchange will take place.

This clause has no impact on the right of retraction that the Customer has.

article 7. right of withdrawal

In accordance with the French Consumer Code, consumers have a period of fourteen (14) calendar days from the date of receipt of the Product to cancel the Order and obtain a refund or an exchange, without giving any reason. The deadline is deemed to have been met if the Product is returned before the deadline expires.

To cancel the order, the Customer must return the Product in its original packaging, in perfect condition for resale (as is, new and unopened) and send a request by registered mail to BOUTIQUE SAINT AIX expressing their wish to cancel the order. The Customer must specify if he wants a credit note or a refund.

The return is at the Customer's risk and expense. Once the product has been checked and found to be in conformity, BOUTIQUE SAINT AIX will reimburse the Customer for the sums paid (excluding delivery costs) within fourteen (14) days using the same means of payment as for the initial transaction.

The right of withdrawal does not apply to products that are unsealed, damaged, used and/or whose original packaging has been damaged.

In the case of an order placed by a Professional Customer, the latter does not benefit from the right of withdrawal provided for by the provisions of the Consumer Code.

article 8. cancellation of the sale

BOUTIQUE SAINT AIX reserves the right to cancel any Order if the Customer fails to comply with the Terms and Conditions of Sale (payment incident, provision of incorrect information).

The Customer has the right to request the cancellation of the sale in the cases mentioned in Articles 6.4 and 7.

article 9. guarantees and commitments

9.1. From BOUTIQUE SAINT AIX

BOUTIQUE SAINT AIX guarantees that the Products conform to the descriptions and characteristics indicated on the Website and respect the regulations in force.

The Products are covered by the legal guarantee against hidden defects.

BOUTIQUE SAINT AIX commits to doing its utmost to offer a Website that is accessible seven days a week except in the case of interruption (voluntary or not) notably for maintenance or force majeure.

9.2. From the Client

The Customer guarantees to be of legal age and to have the legal capacity to purchase the Products.

The Customer undertakes to provide accurate, precise and up-to-date information.

The Customer undertakes not to purchase Products with the aim of reselling them or using them for commercial purposes.

article 10. liability

10.1. The liability of BOUTIQUE SAINT AIX

BOUTIQUE SAINT AIX makes every effort to sell Products in accordance with the GTC.

BOUTIQUE SAINT AIX will only be held liable for the failure to respect the terms of the Contract.

BOUTIQUE SAINT AIX cannot be held liable if the Products delivered are stored or used in abnormal conditions or conditions incompatible with their nature.

If BOUTIQUE SAINT AIX is held liable, it will only be held liable for the sums paid by the Customer to purchase the Products and only direct, personal damages linked to BOUTIQUE SAINT AIX's failure will be compensated. BOUTIQUE SAINT AIX only provides Products for private use. If these Products are used for commercial purposes or resale, BOUTIQUE SAINT AIX cannot be held responsible for any loss of profit, business, or commercial opportunity.

10.2. BOUTIQUE SAINT AIX's liability regarding Internet

The Customer is aware of the technical hazards that can affect the Internet network (and which are inherent to it) and lead to slowdowns or unavailability making connection impossible. BOUTIQUE SAINT AIX cannot be held responsible for access difficulties or possible unavailability or slowdowns due to Internet network disturbances, which the Customer acknowledges.

10.3 Exclusion in case of force majeure

BOUTIQUE SAINT AIX cannot be held liable if the non-execution of its obligations is attributable to the act of a third party, even if it is foreseeable, to the fault, negligence, or error of the Customer or to the occurrence of an act of God or force majeure or any other external and insurmountable event or one that was not reasonably under its control. Acts of God or force majeure include, but are not limited to, pandemic, epidemic, governmental act, war, fire, adverse weather conditions, including snow, flood or storm, explosion or civil commotion, failure of a third party (other than our subcontractors) or computer or telecommunications services, or strike.

10.4. Customer's liabilty

The Customer is solely liable for the accuracy and completeness of the information provided.

The Customer is solely liable for the use of the Products offered by BOUTIQUE SAINT AIX.

article 11. customer service

article 12. intellectual property

Users of the Website or Customers acknowledge and accept that all copyrights, trademarks, and any other intellectual property rights relating to the content appearing on the Website and the Products for sale are and will be, always, the exclusive property of BOUTIQUE SAINT AIX.

The photographs and trademarks used on the Website or affixed to the Products are not royalty free.

The reproduction, adaptation, transformation, or representation, in whole or in part, of all or part of the elements by any process and on any medium whatsoever, is formally forbidden, and constitutes, without prior written authorization, an infringement of copyright engaging the civil and criminal liability of its author.

article 13. non-waiver provision

The fact that BOUTIQUE SAINT AIX does not take advantage of any of the provisions of the GTC at a given time cannot be interpreted as a waiver of the right to take advantage of them later.

article 14. protection of personal data

The provisions concerning the protection of personal data as set out in the French Data Protection Act of 6 January 1978 and modified by the European Regulation on the protection of personal data ("RGPD") are set out in the Privacy Policy. The User and Customer of the Website acknowledges that he/she communicates his/her personal data when he/she places an Order or when he/she check off the box to receive the newsletter.

article 15 - language of the gtcs

The GTC have been written in French and there is a translation in English. Only the French version will be deemed authentic in the event of a dispute, particularly in the event of mediation or before a court.

article 16. disputes - applicable law

This Agreement and the relationship between the Parties shall be governed by and construed in accordance with French law. French law shall apply in the event of disputes, subject to the mandatory rules of the consumer's country of residence.

In the event of a dispute or disagreement that may arise concerning the interpretation, execution or non-execution of the present conditions, the Customer will first contact BOUTIQUE SAINT AIX to try to obtain an amicable solution.

In the absence of an amicable agreement, the consumer may call upon a consumer mediator to find an amicable solution (via the online settlement platform set up by the European Commission accessible from the link below http://ec.europa.eu/consumers/odr).

In the absence of an amicable solution, the dispute will be submitted to the appreciation of the competent court.
